Цель настоящего издания предоставить всем заинтересованным лицам удобное справочное пособие по международным трудовым стандартам, имеющим отношение к правам трудящихся женщин и продвижению гендерного равенства в сфере труда, составленным на основе обстоятельного знакомства с обширной документацией МОТ и консультаций с экспертами по соответствующим темам. Однако пособие необязательно отражает согласованные определения или официальные точки зрения Организации.

For a long time it was assumed that unemployment and underemployment of people with disabilities was closely interrelated to, unavoidable consequence of, the physical and mental impairments of the persons concerned. It is now recognised that many of the disadvantages they face and the fact that they are often excluded are not due to individual impairments, but rather a result of the reaction of society to that impairment. Laws and policies are part of this reaction. These guidelines reflect the reappraisal of disability as a human rights issue. Intended for policy-makers and drafters of legislation, they have been developed with a view to assisting in improving the effectiveness of national laws concerning training and employment of disabled persons, as part of an ILO Project “Promoting Rights and Opportunities for People with Disabilities in Employment through Legislation”.

The Conference Committee on the Application of Standards, a standing tripartite body of the International Labour Conference and an essential component of the ILO’s supervisory system, examines each year the report published by the Committee of Experts on the Application of Conventions and Recommendations. Following the technical and independent scrutiny of government reports carried out by the Committee of Experts, the Conference Committee provides the opportunity for the representatives of governments, employers and workers to examine jointly the manner in which States fulfil their obligations deriving from Conventions and Recommendations. The report of the Conference Committee is submitted for discussion by the Conference in plenary, and is then published in the Record of Proceedings.

In the aftermath of the global economic crisis, the achievement of full, productive and freely chosen employment and decent work remains an elusive goal for many countries. In their quest to achieve full and productive employment, member States have found valuable assistance and support from the ILO. Indeed, it is the ILO’s primary goal to help the countries attain decent work for all, including for women and young people.In supporting member States and the social partners to reach this goal, the ILO pursues a Decent Work Agenda comprising four inter-related areas: respect for fundamental workers’ rights and international labour standards, employment promotion, social protection and social dialogue. The purpose of the present Guide is to show, based on these instruments, how this approach, founded as it is on the development of broad agreement between all those involved in the labour market, a sound policy approach developed over many years by the tripartite constituents from countries at all levels of development, within a rights-based and binding framework, can play a vital role in ensuring that national policy efforts give sufficient importance to the vital issue of employment.

This collection addresses the potential of the European Social Charter to promote and safeguard social rights in Europe. Drawing on the expertise of the ETUI Transnational Trade Union Rights expert network from across Europe, it provides a comprehensive commentary on these fundamental rights. Taking a two part approach, it offers an in-depth legal analysis of the European Social Charter as a new social constitution for Europe, investigating first the potential of the general legal frame in which the Charter is embedded. In the second phase a series of social rights which are related to the employment relation are examined in particular in light of the jurisprudence of the European Committee of Social Rights (ECSR), to demonstrate the crucial but difficult role of the Charter's supervisory bodies to secure the respect and promotion of social rights and national level, bearing in mind the reciprocal influence of other international social rights instruments. This examination is timely, given the pressure exerted on those rights during the recent period of economic crisis. Furthermore, in the light of the predominantly economic vision of Europe, such analysis is crucial.
The collection is aimed at stimulating academic scrutiny and raising awareness amongst practitioners and trade unions about this important and equally necessary anchor of the social dimension of Europe in legal and political practice.
